The purpose of the present general conditions of sale is to inform any potential consumer, company or person, about the conditions and modalities in which the company – YuKik – proceeds with the sale and delivery of the ordered products.
These general conditions of sale also define the rights and obligations of the parties in the context of the sale of products by the seller to the consumer. They apply, without restriction or reservation, to all sales, by the seller, of products offered on its website: yukik.com and all its aliases (yukik.fr, etc.). All orders placed on this website imply acceptance of these conditions.
ARTICLE 1 – PRICES
1.1. The prices of our products are indicated in euros including all taxes, subject to a modification of the French VAT rate. The prices are indicated excluding shipping costs, which are invoiced in addition to the price of the products purchased according to the amount of the order.
1.2. Orders are payable according to the territories: European Union countries, except UK in Euros €, UK: in Pounds, US in Dollars $ and for other countries your choice of the 3 currencies above.
1.3. YuKik reserves the right to modify its prices at any time but the products will be invoiced on the basis of the prices in effect at the time of order registration, subject to availability at that time. This modification will be indicated to the buyer before any order.
1.4. The VAT rate indicated on the order form is the one applicable on the day of the order. 1.5. The VAT rate applicable, regardless of the buyer’s origin, is the seller’s rate, i.e. 5.5% or 20% depending on the product.
1.6. If the delivery takes place outside the territory of the European Union, the customs taxes and formalities relating thereto remain the exclusive responsibility of the purchaser.
ARTICLE 2 – RETENTION OF TITLE
ARTICLE 3 – ORDERING
Orders placed on the yukik.com website are subject to several steps which are as many validations by click to be made by the buyer. The final validation during the ordering process is equivalent to an agreement to accept the information related to these Terms and Conditions of Sale.
ARTICLE 4 – VALIDATION
The consumer must be informed by the seller of the essential characteristics of the goods, before the conclusion of the contract. This being the case, you declare that you have read and accepted the present General Conditions of Sale before placing your order.
ARTICLE 5 – COMMITMENT
When you validate your order, this validation means acceptance of these General Conditions of Sale. Its application cannot be called into question, unless you withdraw within 14 days of receiving the order.
ARTICLE 6 – ORDER CONFIRMATION
In accordance with article 1369-2 of the French Civil Code, the seller YuKik commits to confirm your order by means of an acknowledgement of receipt sent by e-mail within 24 hours. This confirmation will specify the content of the order, its cost, the method of payment and the delivery terms.
ARTICLE 7 – EVIDENCE
Unless proven otherwise, the data recorded on YuKik websites which remain archived by the seller, constitute proof of all transactions between YuKik and its customers.
ARTICLE 8 – DISPONIBILITE
yukik.com is a commercial site offering for sale items related to football. As stipulated in Article 1369-1 of the Civil Code, the product offers and prices shown on this site are valid as long as they are visible on the site, within the limits of available stocks. For products not stored in our warehouse, our offers are valid subject to availability from our suppliers. In this context, indications on the availability of products are provided to you at the time of placing your order. Consequently, any claim requiring the supply of a product not available will be considered unfounded. This information comes directly from our suppliers, errors or modifications may exceptionally exist. In the event that a product is not available after you have placed your order, YuKik will inform you of this unavailability within 5 days from the reception of your order. By email (if correctly specified) or by any other means at your convenience (if you request it). We commit ourselves not to debit your account for any order validated by telephone and concerning a payment by bank card or check sent.
However, the order of an item or a product that is no longer available and whose payment has been validated by credit card on our secure site will be immediately validated and cashed before being reimbursed; the security configuration of the system does not allow YuKik to interact between your personal data provided to the bank and its own site. YuKik commits to reimburse you for the amount of your order within 30 days in case your payment is debited or cashed for an unavailable product or item:
– at your exclusive request in the case of payment by credit card,
– by bank transfer within 30 working days following receipt of a bank account number (RIB) belonging to you.
ARTICLE 9 – PRICES AND DELIVERY
The products purchased on the site are shipped according to the deadlines defined in the paragraph “Delivery” following the validation of the payment and the obtaining of the customs documents if necessary (Outside EU). The products are delivered to the delivery address that you have indicated during the ordering process. However, in order to protect you against fraud, YuKik reserves the right to deliver only to your billing address in the absence of an order history that can justify its regularity. In case of delay, an email will be sent to you. The delivery time is 30 days maximum, the seller will not be held responsible for the delay in case of force majeure. In case of payment by credit or debit card, the times indicated are average times and correspond to the processing and delivery times for products destined for metropolitan France and Monaco.
9.2 – Delivery problems
You must notify the carrier and YuKik of any reservations about the delivered product (for example : damaged package, already opened…) within 3 days after receiving the product. If the package is lost or not received, please contact us as soon as possible in order to check with the delivery service.
9.3 – Product compliance
YuKik will refund or exchange the products that do not correspond to your order. In this case, we thank you for sending us back the product(s). YuKik will exchange or refund the product(s). The request must be made within 15 working days following the delivery. Any claim made outside of this period will not be accepted. The products must be returned in the same condition in which you received them with all the elements delivered (box, basket, packaging). The shipping costs will be reimbursed on the basis of the invoiced rate.
In any case you benefit from the provisions of the legal guarantee, in particular those relating to the guarantee of hidden defects. The provisions of this article do not prevent you from benefiting from the right of withdrawal (satisfied or refunded) provided for in Article 5. All the specific provisions relating to the delivery of the order are detailed in the “Delivery” section of the site, which can be detailed on a separate page depending on the navigation methods.
ARTICLE 10 – PAYMENT
You can pay for your purchases by credit card (Visa, MasterCard, other credit cards) on the secure and encrypted website of Paypal and/or any other online payment company in commercial agreement with YuKik. A validated payment means the irrevocable acceptance of your order under the following conditions: After validating your order on the yukik.com website, you pay your purchases by credit card or on the secure Paypal website. None of your personal banking information is transmitted to the seller. YuKik reserves the right to change Internet banking service providers that meet similar security criteria to ensure your transaction. The payment of the totality of the price must be realized at the time of your order. At no time, the amount paid can be considered as a deposit. The payment of the total amount of the order will be made by YuKik at the time of the validation of the order. After receiving the customer’s order, YuKik reserves the right to ask the customer for any proof of payment.
ARTICLE 11 – REFUND AND EXCHANGE
Refunds of products in the cases referred to in Article 5 will be made within 30 days or less after receipt of the products by us. The refund will be made at your choice by re-crediting your bank account or by check addressed to the name of the person who placed the order and to the billing address. No COD shipment will be accepted for any reason. Personalized / flocked items are not exchangeable or refundable.
ARTICLE 12 – SATISFIED OR REFUNDED
In accordance with article L 121-20 of the French Consumer Code, you have a period of days from receipt to exchange or be reimbursed for the product that does not suit you. If this period normally expires on a Saturday, a Sunday or a public holiday, it is extended until the next working day. In accordance with the Chatel Law of 1 June 2008, refunds following a right of withdrawal will be made mainly by means of payment, even if other alternatives (such as vouchers) remain possible, and they concern the totality of the sums paid (thus including the delivery costs). The costs of returning the goods remain the responsibility of the buyer. Refunds will be made as soon as possible, and at the latest within 30 days following the date this right has been exercised. Returns are to be made to YuKik : please contact us by email to define the terms and conditions. This right of return can only be accepted for products in their original packaging, complete, in good condition and accompanied by a copy of the purchase invoice. Items returned incomplete, damaged or soiled by the customer will not be accepted. If the customer wishes it, beyond the 14 days of retractation, the sold out articles which were nevertheless ordered by the customer can be the subject of a credit note but in no case of refunding.
ARTICLE 13 : SECURITY
For payment by credit card, our site is subject to a security system developed by CB and Paypal. This service uses SSL encryption and security data. The data you provide (card number, expiry date and cryptogram) do not transit, neither with the company, nor with the site yukik.com reserves the right to modify the choice of its supplier of online payment system without having to warn you. This choice will be made in any case towards a supplier guaranteeing optimal transaction conditions.
ARTICLE 14 – INTELLECTUAL PROPERTY
In accordance with the provisions of the code of intellectual property, only the use for a private use subject to different provisions even more restrictive of the code of intellectual property is authorized. Any total or partial reproduction of the yukik.com website is strictly forbidden.
ARTICLE 15 – IPERSONAL INFORMATION
YuKik commits to not divulge to third parties the information you give us. This information is confidential. They will only be used to process your order and to reinforce and personalize the communication and product reserved for YuKik customers, notably through the newsletters published on the yukik.com website to which you will have subscribed as well as within the framework of the personalization of the website according to your centers of interest. Concerning this information you have a right of access, rectification and opposition to the personal data concerning you. To do so, simply send us a request online or by mail, indicating your name, first name, address and, if possible, your customer reference.
ARTICLE 16 – LIABILITY
The products offered are in accordance with the French legislation and the standards applicable in France. YuKik Company cannot be held responsible in case of non-compliance with the legislation of the country where the product is delivered (for example in case of a product ban…). It is your responsibility to check with the local authorities the possibilities of importing or using the products or services you plan to order. The photographs and graphics reproduced and illustrating the products presented are given as an indication. YuKik will not be held responsible for the non-execution of the contract in case of force majeure, stock shortage, disruption or total or partial strike of the postal services and means of transport and/or communications, flooding, fire. In case of professional purchases, the company will not be held responsible for any indirect damage, operating loss, loss of profit, loss of opportunity, damages or expenses that may occur due to the purchase of the products. YuKik will not be held responsible for any indirect damage that may occur due to the purchase of the products. The seller cannot be held responsible, in the event of absence of the recipient at the delivery of the Products and/or in the event that you (or the person designated by you) would withdraw late or would not withdraw the Products from the carrier after the latter has delivered a notice to the recipient.
Note about phishing : it’s a way to deceive the vigilance of the Internet user, by copying perfectly a website and by making the consumer believe that he is ordering on the official website of the merchant. In the event that the YuKik seller would be a victim of this manipulation, he cannot be held responsible since he is a victim himself.
ARTICLE 17 – APPLICABLE LAW – DISPUTES
This contract is subject to French law. The language of this contract is French. In the event of a dispute, the courts of Paris (75-France) shall have exclusive jurisdiction.
ARTICLE 18 – COOKIE
The user is informed that during his visits to the site, a cookie may be automatically installed on his browser (a cookie is a block of data that does not identify him but which is used to record information relating to his navigation on the site). In general, this cookie contains an identification number or code that allows us to recognize you when you return to our site. The implementation of these systems simply allows us to collect statistical data in order to improve our site and better meet your needs. The data concerned is in no way transferred to third parties.
